This limited warranty shall apply to the HTC product (the “Product”). HTC warrants that the product is at the time of its original purchase free of defects in materials and workmanship (“Limited Warranty”). THIS LIMITED WARRANTY DOES NOT AFFECT YOUR STATUTORY RIGHTS. This Limited Warranty is subject to the following terms and conditions: 1. This Limited Warranty is given only to the original purchaser of the Product (“Customer”). This Limited Warranty may, however, be transferred to any individual to whom the Product is sold, where HTC has consented in writing to the transfer (and HTC will not unreasonably refuse consent). It shall neither exclude nor limit a) any statutory rights of the Customer or b) any of the Customer’s rights against the seller/dealer of the Product. 2. This Limited Warranty shall last for twenty-four (24) months from the date of original purchase for mobile devices, and twelve (12) months for accessories (whether included in the mobile device sales package or sold separately) other than the media on which any software is provided, CD-ROM, memory card (“Warranty Period”). Customer shall present the PROOF OF PURCHASE upon claiming this Limited Warranty. This Limited Warranty is only valid and enforceable in the countries where the Product is sold. However, if you have purchased

Switzerland or Turkey and HTC originally intended the Product for sale in one of these countries, this Limited Warranty is valid and enforceable in all of these above listed countries. Moreover, if Product is purchased in places other than those stated above, HTC attempts to repair such Product but can not guarantee the outcome. Warranty service availability and response times may vary from country to country and may also be subject to a registration requirement in the country of purchase. 3. Throughout the Warranty Period HTC or its authorized agent will, at their discretion, without charge and subject to Clause 7 repair or replace a defective Product. Repair or replacement may involve the use of functionally equivalent reconditioned unit. HTC will return the repaired Product or replaced with another functional equivalent Product to the Customer in good working condition. All replaced faulty parts or components will become the property of HTC. 4. This Limited Warranty applies only to the hardware components of the Product as originally supplied and does not apply to any software or other equipment. 5. If HTC repairs or replaces the Product, the repaired or replaced Product shall continue to be warranted for the remaining time of the original Warranty Period or for three (3) months from the date of repair or replacement, whichever is longer. 6. Before returning any unit for service, be sure to back up data and

the Product. HTC is not responsible for the damage to or loss of any programs, data, or removable storage media where you do not back- up your data. 7. THIS LIMITED WARRANTY SHALL NOT APPLY IF THE DEFECT WAS CAUSED THROUGH ANY OF THE FOLLOWING: a) the Product serial number, the accessory date code the IMEI number, water indicator or the warranty seal has been removed, erased, defaced, altered or is illegible; or b) deterioration of the Product due to normal wear and tear; or c) use other than in accordance with the user manual, rough handling, exposure to moisture, dampness or extreme thermal or environmental conditions or a rapid change in such conditions, corrosion, oxidation, unauthorized modifications or connections, unauthorized opening or repair, repair by use of unauthorized spare parts, accidents, forces of nature, or other actions beyond the reasonable control of HTC (including but not limited to deficiencies in consumable parts) unless the defect was caused directly by defects in materials or workmanship. This Limited Warranty does not cover physical damage to the surface of the Product including but not limited to cracks or scratches on the LCD screen or camera lens; or d) the defects caused by the fact that the battery has been short- circuited or by the fact that the seals of the battery enclosure

fact that the battery has been used in equipment other than those for which it has been specified; or e) the defect was caused by a defective function of the cellular network or other system; or f) the Product software needs to be upgraded due to changes in cellular network parameters; or g) the defect was caused by the fact that the Product was used with or connected to an accessory not approved or provided by HTC or used in other than its intended use and where it can be shown by HTC that such defect is not the fault of the Product itself. 8. Your Product may contain country specify elements, including software, If the Product has been re-exported from its original destination country to another country, the Product may contain country specific elements that are not considered to be a defect under this Limited Warranty. ANY CLAIM UNDER THIS LIMITED WARRANTY IS SUBJECT TO YOU NOTIFYING HTC OR A HTC AUTHORIZED SERVICE AGENT OF THE ALLEGED DEFECT WITHIN A REASONABLE TIME OF IT HAVING COME TO YOUR ATTENTION AND IN ANY EVENT NO LATER THAN BEFORE THE EXPIRY OF THE WARRANTY PERIOD. 9. In the event of Product failure, the Customer should take the following actions: a) Refer to the user manual in order to identify and possibly correct

manual the Customer should then contact the dealer where such Product was purchased or visit your local HTC website, or HTC service center or www.htc.com for further information. c) Before the Customer contacts HTC service agent, please ensure the following information is at hand: • The model and serial number, IMEI number of the Product. • The Customer’s full address and contact information. • A copy of the Customers original invoice, receipt or bill of sale of the purchase of the Product. HTC will provide the Customer with instructions regarding how and when the defective Product should be returned. HTC will pay costs in connection with both the return of the defective product to HTC and the repaired Product back to the Customer if the Defective Product is within the Warranty Period. 10. THIS LIMITED WARRANTY STATES THE ENTIRE WARRANTY GIVEN BY HTC TO THE CUSTOMER. IN NO EVENT SHALL HTC BE LIABLE UNDER THIS LIMITED WARRANTY FOR LOSS OF PROFIT, LOSS OF ANTICIPATED SAVINGS, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, OR INDIRECT, INCIDENTAL OR CONSEQUENTAL LOSSES OR DAMAGES OF ANY NATURE WHATSOEVERTO THE FULLEST EXTENT THAT THOSE LOSSES OR DAMAGES CAN BE DISCLAIMED BY LAW.

PROVISION OF THIS LIMITED WARRANTY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE HARDWARE. HTC does not exclude or limit liability for personal injury or death resulting from its own negligence, for defects in the Product arising out of its or its manufacturers’ negligence. THE LAWS OF CERTAIN COUNTRIES MAY STATE THAT THE MANUFACTURER MAY NOT EXCLUDE OR LIMIT ASPECTS OF ITS LIABILITY TO THE CONSUMER. WHERE THAT IS THE CASE, THE EXCLUSIONS AND LIMITATIONS OF LIABILITY IN THIS LIMITED WARRANTY WILL NOT APPLY. This warranty gives the Customer specific legal rights; the Customer may also have other rights, which may vary from country to country. This limited warranty does not affect the Customers statutory rights in law specific to the country of purchase, such rights remain protected. Wenn der Kunde Ansprüche basierend auf dieser Beschränkten Garantie erhebt, muss er einen KAUFBELEG vorlegen. Diese Beschränkte Garantie ist nur in Ländern gültig und einklagbar, in denen das Produkt verkauf wird. Falls Sie aber das Produkt in einem Mitgliedsstaat der Europäischen Union, in Island, in Norwegen, in der Schweiz oder in der Türkei gekauft haben, und HTC ursprünglich das Produkt zum Verkauf in einem dieser Länder bestimmt hat, ist diese Beschränkte Garantie in all den oben aufgelisteten Ländern gültig und einklagbar. Falls Sie das Produkt in einem anderen Land als den oben angeführten Ländern gekauft haben, versucht HTC, das Produkt zu reparieren, gibt aber keine Garantie auf das Ergebnis. Die Verfügbarkeit der durch die Garantie abgedeckten Dienstleistungen und die Antwortzeit des Reparaturdienstes können sich von Land zu Land unterscheiden, und evtl. ist eine Registrierung im Land, in dem der Kauf erfolgte, erforderlich. 3. Während der Garantiedauer repariert oder ersetzt HTC oder ein von HTC autorisierter Vertreter ein fehlerhaftes Produkt nach eigenem Ermessen gebührenfreu gemäß Absatz 7. Bei Reparatur oder Ersatz können funktional gleichwärtige überholte Einheiten verwendet werden. HTC gibt das reparierte Produkt dem Kunden zurück oder ersetzt es durch ein anderes funktional gleichwärtiges Produkt in gut funktionierender Verfassung. Alle ersetzten fehlerhaften Teile oder Komponenten werden zum Eigentum von HTC. 4. Diese Beschränkte Garantie gilt nur für die Hardware-Komponenten des Produkts, die ursprünglich ausgeliefert wurden. DIESE BESCHRÄNKTE GARANTIE GILT IN FOLGENDEN FÄLLEN NICHT: a) Die Seriennummer des Produkts, der Datencode des Zubehörs, die IMEI-Nummer, das Wasserzeichen oder das Garantiesiegel wurde entfernt, gelöscht, unkenntlich gemacht, geändert oder ist unleserlich; oder b) Das Produkt hat sich aufgrund von normalem Verschleiß verschlechtert; oder c) Das Produkt wurde nicht gemäß den Anweisungen in der Bedienungsanleitung benutzt; es wurde grob behandelt; es wurde Feuchtigkeit, Nässe oder extremen Temperaturen und anderen Umweltbedingungen oder schnellem Wechseln dieser Bedingugnen ausgesetzt; es kommt zu Rostbildung oder Oxidation; es wurden unzulässige Änderungen oder

Erlaubnis geöffnet oder repariert; Reparaturen wurden unter Verwendung nicht zugelassener Ersatzteile durchgeführt; es wurde durch Unfälle, Naturgewalten oder andere Aktionen beschädigt, die nicht von HTC kontrolliert werden können (einschließlich aber nicht beschränkt auf Fehler in für den Verbrauch bestimmten Teilen), es sei denn, der Schaden kann direkt auf Fehler in Material oder Verarbeitung zurückgeführt werden. Diese Beschränkte Garantie deckt keine physischen Schäden der Oberfläche des Produkts ab, einschließlich aber nicht beschränkt auf Risse oder Kratzer auf dem LCD-Display oder dem Kameraobjektiv; oder d) Die Fehler können darauf zurückgeführt werden, dass der Akku kurzgeschlossen wurde; die Siegel des Akkugehäuses oder der Zellen wurden aufgebrochen; es gibt deutliche Hinweise darauf, dass das Produkt manipuliert wurde; der Akku wurde in einem Gerät verwendet, für das er nicht vorgesehen ist; oder e) Der Schaden kann auf eine Fehlfunktion des Funknetzwerks oder eines anderen Systems zurückgeführt werden; oder f) Die Produkt-Software muss auf Grund von Änderungen an den Parametern des Funknetzwerks aktualisiert werden; oder g) Der Fehler kann darauf zurückgeführt werden, dass das Produkt mit Zubehör benutzt oder an dieses angeschlossen wurde, das nicht von HTC zugelassen wurde; es wurde für Zwecke verwendet, für die es nicht bestimmt ist; HTC kann nachweisen,

8. Ihr Produkt enthält u.U. länderspezifische Elemente, einschließlich Software. Falls das Produkt vom ursprünglichen Zielland aus erneut in ein anderes Land exportiert wurde, kann das Produkt länderspezifische Elemente enthalten, die unter dieser beschränkten Garantie nicht als Defekt angesehen werden. HTC garantie que le produit au moment de son premier achat ne comporte aucun défaut de matériel et de fabrication (« Garantie limitée »). LA PRÉSENTE GARANTIE LIMITÉE N’AFFECTE PAS VOS DROITS LÉGAUX. La présente Garantie Limitée est sujette aux termes et conditions suivants : 1. La présente Garantie Limitée n’est accordée qu’au premier acheteur du Produit (« Client »). Cependant, si vous avez acheté le Produit dans un État membre de l’Union européenne, en Islande, en Norvège, en Suisse ou en Turquie et si HTC avait destiné le Produit à la vente dans l’un de ces pays, la présente Garantie Limitée est valable et s’applique dans tous les pays énumérés ci-dessus. Si HTC répare ou remplace le Produit, le Produit réparé ou remplacé continuera à être couvert par la garantie pendant le temps restant

LA PRÉSENTE GARANTIE LIMITÉE N’EST PAS APPLICABLE POUR LES DÉFAUTS DUS AUX CAUSES SUIVANTES : a) Le numéro de série du Produit, le code de date de l’accessoire, le numéro IMEI, l’indicateur d’eau ou le scellé de garantie a été retiré, effacé, abîmé, altéré ou est illisible. b) La détérioration du Produit est due à l’usure normale. c) Une utilisation contraire aux instructions du manuel d’utilisation, une manipulation brutale, une exposition à l’humidité ou à des conditions thermiques ou environnementales extrêmes ou une modification rapide de ces conditions, la corrosion, l’oxydation, des modifications ou des connexions non autorisées, une ouverture ou une réparation non autorisée, une réparation avec l’utilisation de pièces non autorisées, des accidents, les forces de la nature ou toutes autres actions raisonnablement indépendantes du contrôle de HTC (y

remplacées périodiquement), à moins que le défaut ne soit causé directement par des défauts de matériel ou de fabrication. La présente Garantie Limitée ne couvre pas les dommages physiques à la surface du Produit, y compris, mais pas seulement, les fêlures ou les rayures sur l’écran LCD ou l’objectif de l’appareil photo. d) Les défauts causés par le court-circuit de la batterie, causés par la rupture ou l’altération des scellés sur le boîtier de la batterie ou causés par l’utilisation de la batterie dans un équipement autre que celui pour laquelle elle a été spécifiée. e) Le défaut a été causé par une fonction défectueuse du réseau cellulaire ou d’un autre système. f) Les logiciels du Produit doivent être mis à jour du fait de modifications dans les paramètres du réseau cellulaire. g) Le défaut a été causé par l’utilisation ou la connexion du Produit avec ou à un accessoire non approuvé ou non fourni par HTC ou une utilisation autre que celle prévue et pour laquelle HTC peut démontrer qu’un tel défaut n’est pas dû au Produit lui-même. 8. Votre Produit peut contenir des éléments spécifiques au pays, y compris les logiciels. Si le Produit a été réexporté de son pays de première destination vers un autre pays, le Produit peut contenir des éléments spécifiques au pays qui ne sont pas considérés comme un défaut dans le cadre de la présente Garantie Limitée.

La presente garanzia limitata si applica al prodotto HTC (il “Prodotto”). HTC garantisce che il prodotto è esente da difetti nei materiali e di fabbricazione al momento dell’acquisto (“Garanzia limitata”). Garanzia limitata è valida e applicabile esclusivamente nei paesi in cui è avvenuto l’acquisto del Prodotto. Tuttavia, in caso di acquisto del Prodotto in uno stato membro dell’Unione Europea, o in Islanda, Norvegia, Svizzera e Turchia, e nel caso in cui questo risulti conforme a quanto originariamente stabilito da HTC, questa Garanzia Limitata sarà valida ed efficace in tutti i paesi indicati in precedenza. Inoltre, in caso di acquisto del Prodotto in luoghi non compresi in quelli precedentemente specificati, HTC si impegna a tentatare di riparare il Prodotto senza garanzie in merito al risultato. La disponibilità del servizio di garanzia e i tempi di risposta potrebbero variare da paese a paese, e potrebbero inoltre essere soggetti a requisiti di registrazione nel paese in cui è avvenuto l’acquisto. 3. Per tutto il periodo di validità della Garanzia, HTC o un agente autorizzato si impegneranno, a propria discrezione e senza oneri aggiuntivi, e in conformità alla Clausola 7, a riparare o sostituire il Prodotto difettoso. Parti o componenti guasti per cui sia stata effettuata una sostituzione diventeranno proprietà di HTC. 4. La presente Garanzia limitata si applica esclusivamente ai componenti hardware originali del Prodotto, e non copre software o altre apparecchiature.

HTC non è responsabile per danni o perdite di programmi, dati o supporti di memorizzazione rimovibili causati dalla mancata esecuzione del backup dei dati. 7. LA PRESENTE GARANZIA LIMITATA NON È APPLICABILE PER DIFETTI CAUSATI DA: a) rimozione, cancellazione, alterazione o illeggibilità di numero di serie del Prodotto, codice riportante la data dell’accessorio, numero IMEI, indicatore tenuta stagna o sigillo di garanzia; o b) deterioramento del Prodotto dovuto a normale logoramento o rottura; o c) usi diversi da quelli indicati nel manuale utente, maneggiamento improprio, esposizione a umidità, a condizioni termiche o ambientali estreme o soggette a variazioni repentine, corrosione, ossidazione, modifiche o connessioni non autorizzate, aperture o riparazioni non autorizzate, riparazioni per mezzo di parti di ricambio non autorizzate, incidenti, cause

non limitati a, difetti nei componenti di consumo), a meno di problemi causati direttamente da difetti nei materiali o di lavorazione. La presente Garanzia limitata non copre danni fisici alla superficie del Prodotto, compresi ma non limitati a incisioni o graffi sullo schermo LCD o sull’obiettivo della fotocamera; o d) difetti causati da cortocircuito alla batteria o da rottura dei sigilli del vano batterie o delle celle, o a evidenti manomissioni o utilizzo improprio della batteria con apparecchiature diverse da quelle specificate; o e) difetti causati dal funzionamento improprio della rete cellulare o di altri sistemi; o f) necessità di aggiornare il software del Prodotto a causa di modifiche apportate ai parametri della rete cellulare; o g) difetti causati dall’utilizzo del Prodotto con o della sua connessione a accessori non approvati o distribuiti da HTC, da utilizzo diverso da quello previsto, o nei casi in cui HTC fosse in grado di dimostrare che il difetto non deriva da guasti al Prodotto medesimo. 8. Il Prodotto potrebbe contenere elementi specifici per paese, compresi software. In caso di riesportazione dal paese di destinazione originale a un altro paese, il Prodotto potrebbe contenere elementi specifici per paese non considerati come difetti ai sensi della presente Garanzia limitata.

GARANZIA LIMITATA DEVE ESSERE COMUNICATO A HTC O ALL’AGENTE AUTORIZZATO DA HTC CON INFORMAZIONI RELATIVE AL PRESUNTO DIFETTO RILEVATO, ENTRO UN TEMPO RAGIONEVOLE DALLA SUA INDIVIDUAZIONE E IN OGNI CASO ENTRO E NON OLTRE LA SCADENZA DEL PERIODO DI GARANZIA. 9. In caso di guasto al Prodotto, il Cliente è tenuto a: a) Consultare il manuale utente per identificare e eventualmente risolvere il problema. b) Se il problema non può essere risolto con le indicazioni fornite dal manuale utente, si prega il Cliente di contattare il rivenditore da cui è stato acquistato il Prodotto o visitare il sito Web HTC locale, o il centro di assistenza HTC, o visitare il sito www.htc. com per maggiori informazioni. c) Prima di contattare il centro di assistenza HTC, il Cliente è tenuto a verificare di essere in possesso delle seguenti informazioni: • Modello, numero di serie, numero IMEI del Prodotto. • Indirizzo completo e contatti del Cliente medesimo. • Una copia di fattura, ricevuta o scontrino originale rilasciati al Cliente, a prova dell’avvenuto acquisto del Prodotto. HTC si impegna a fornire al Cliente istruzioni in merito alla modalità e al tempo di restituzione del Prodotto. HTC si impegna a sostenere i costi derivati dalla restituzione del prodotto difettoso a HTC e del Prodotto riparato al Cliente, purché il Prodotto sia ancora

10. LA PRESENTE GARANZIA LIMITATA RAPPRESENTA LA GARANZIA COMPLETA RILASCIATA DA HTC AI CLIENTI. HTC non esclude o limita responsabilità derivanti da lesioni personali o decessi causati da propria negligenza, da difetti nel Prodotto per negligenza nella fabbricazione. LE LEGGI VIGENTI IN ALCUNI PAESI STABILISCONO CHE IL COSTRUTTORE NON È AUTORIZZATO A ESCLUDERE O LIMITARE ALCUNE RESPONSABILITÀ NEI CONFRONTI DEL CLIENTE. La presente garantía limitada es exclusivamente de aplicación a los productos de HTC (el “Producto”). HTC garantiza que el producto, en la fecha de compra original, está libre de defectos de materiales y mano de obra (“Garantía Limitada”). LA PRESENTE GARANTÍA LIMITADA NO AFECTA A SUS DERECHOS LEGALES. Esta Garantía Limitada está sujeta a los siguientes términos y condiciones: 1. Antes de devolver una unidad para una revisión, asegúrese de hacer una copia de seguridad de los datos y eliminar cualquier contenido confidencial o información personal del Producto. HTC no se responsabiliza de la pérdida o desperfectos causados a cualesquiera de los programas, datos o medios de almacenamiento extraíbles de los cuales no haya hecho copia de seguridad. 7. ESTA GARANTÍA LIMITADA NO SERÁ APLICABLE A CUALQUIER DEFECTO CAUSADO POR CUALQUIERA DE LOS SIGUIENTES MOTIVOS: a) Si el número de serie del Producto, el código de fecha del accesorio, el número IMEI, el indicador del nivel del agua o el sello de garantía se han extraído, borrado, desfigurado, modificado o son ilegibles; o b) por deterioro del Producto debido a un desgaste normal; o c) cualquier otro uso distinto al descrito en el manual del usuario, una manipulación indebida, condiciones de humedad, medioambientales o térmicas extremos o un cambio repentino de dichas condiciones, corrosión, oxidación, modificaciones o conexiones no autorizadas, reparación o apertura del

no autorizadas, accidentes, fuerzas de la naturaleza, u otras circunstancias ajenas a la voluntad de HTC (incluyendo a modo enunciativo pero no limitativo, deficiencias en piezas consumibles), a no ser que el daño haya ocurrido directamente por defectos en los materiales o de mano de obra. La Garantía Limitada excluye los daños físicos en la superficie de producto, incluyendo entre otros aspectos, grietas o arañazos en la pantalla LCD o en el objetivo de la cámara; o d) los defectos causados por el hecho de que la batería se haya puesto en cortocircuito o por el hecho de que los sellos de la carcasa o celdas de la batería estén rotas o muestren signos de una manipulación imprudente, o por el hecho de que la batería se haya utilizado en un equipo distinto a aquellos para los cuales está prevista; o e) si el defecto ha sido causado por un mal funcionamiento de la red celular u otro sistema; o f) si el software del Producto debe actualizarse debido a modificaciones en los parámetros de la red celular; o g) si el defecto ha sido causado por el hecho de que el Producto fue utilizado junto a o conectado a un accesorio ni autorizado ni suministrado por HTC, o un uso del producto fuera de los usos permitidos o para los que esté destinado, y en aquellos casos en que HTC pueda demostrar que dicho defecto no es un fallo del propio Producto.

PROVA DE COMPRA. Esta Garantia Limitada é aplicável e válida apenas nos países onde o Produto é vendido. No entanto, se tiver adquirido o produto num Estado-membro da União Europeia, Islândia, Noruega, Suíça ou Turquia e seja o objectivo da HTC ter o produto à venda no país em causa, esta Garantia Limitada é válida e aplicável em todos os países anteriormente mencionados. Durante o Prazo de Garantia, a HTC ou um seu agente autorizado, efectuará à sua discrição, sem encargos e sujeito à cláusula 7, a reparação ou substituição do Produto anómalo. A reparação ou substituição poderá implicar o uso de uma unidade recondicionada de funcionalidade equivalente. A HTC devolverá ao Cliente o Produto reparado ou substituído por outro Produto de funcionalidade equivalente em boas condições de funcionamento. Todos os componentes ou peças avariados tornar-se-ão propriedade da HTC. 4. Esta Garantia Limitada é aplicável apenas aos componentes de hardware do Produto tal como foi fornecido originalmente e não é aplicável a software ou qualquer outro equipamento. 5. Se a HTC reparar ou substituir o Produto, o Produto reparado ou

ESTA GARANTIA LIMITADA NÃO SERÁ APLICÁVEL SE O DEFEITO FOR CAUSADO POR UM DOS SEGUINTES MOTIVOS: a) o número de série do Produto, o código de data de acessórios, o número IMEI, o indicador de água ou o selo de garantia foram removidos, apagados, estragados, alterados ou estão ilegíveis; ou b) deterioração do Produto causada por desgaste e uso normais; ou c) utilização diferente da descrita no manual do utilizador, manuseamento incorrecto, exposição do aparelho a humidade ou a condições térmicas ou ambientais extremas ou a mudanças bruscas de tais condições, corrosão, oxidação, alterações não autorizadas, abertura ou reparação não autorizada, reparação por utilização de peças sobressalentes não autorizadas, acidentes, fenómenos naturais ou outras acções fora do

Esta Garantia Limitada não abrange os danos físicos na superfície do Produto, incluindo mas não se limitando a riscos ou fendas no ecrã LCD ou lente de câmara; ou d) os defeitos causados pelo facto de a bateria ter entrado em curto-circuito ou pelo facto de os vedantes da bateria ou as suas células se terem rompido ou mostrarem indícios de terem sido adulterados ou pelo facto de a bateria ter sido usada em equipamentos diferentes daqueles a que se destina; ou e) o defeito causado por um funcionamento defeituoso da rede celular ou outro sistema; ou f) o software do Produto precisa de ser actualizado devido a alterações nos parâmetros da rede celular; ou g) o defeito foi causado pelo facto de o Produto ter sido usado com ou ligado a um acessório não aprovado ou fornecido pela HTC, ou ter sido utilizado para um fim diferente daquele a que se destina, e a HTC poder mostrar que tal defeito não é falha do Produto em si. 8. O seu produto poderá conter elementos específicos para o seu país, incluindo software. Se o Produto tiver sido reexportado do país de destino original para um outro país, o Produto poderá conter elementos específicos desse país que não são considerados um

No caso de uma falha do Produto, o Cliente deve efectuar as seguintes acções: a) Consultar o manual do utilizador de modo a identificar e, possivelmente, corrigir o problema. b) Se não for possível solucionar o problema através das indicações contidas no manual do utilizador, o Cliente deve entrar em contacto com o revendedor da loja onde foi adquirido o Produto ou visitar o website da HTC, o centro de assistência técnica da HTC ou www.htc.com para obter mais informações. c) Antes de contactar a empresa de assistência da HTC, certifique- se de que tem à mão as seguintes informações: • O número de série e modelo e o número IMEI do Produto. • Morada completa do Cliente e informações de contacto. • Uma cópia da factura original do Cliente, recibo ou talão da compra do Produto. A HTC dará ao Cliente as instruções sobre como e onde o Produto avariado deve ser entregue. A HTC paga os custos relativos à entrega do produto defeituoso

avariado estiver dentro do Prazo de Garantia. 10. ESTA GARANTIA LIMITADA EXPRESSA A GARANTIA TOTAL DADA PELA HTC AO CLIENTE. “Product”). HTC garandeert dat het product op het moment van aanschaf vrij van materiaal- en fabricagefouten (“Beperkte garantie”). DEZE BEPERKTE GARANTIE HEEFT GEEN INVLOED OP UW WETTELIJKE RECHTEN. Deze Beperkte Garantie is onderhevig aan de volgende voorwaarden en bepalingen: 1. De Beperkte garantie wordt alleen toegekend aan de originele koper van het Product (“Klant”). Deze Beperkte garantie mag echter worden overgedragen aan elke persoon waaraan het Product is verkocht, mits HTC de overdracht schriftelijk heeft goedgekeurd (HTC zal toestemming redelijkerwijze bieden). Het vormt geen uitsluiting of beperking van a) wettelijke rechten van de Klant of b) rechten van de Klant ten opzichte van de verkoper/dealer van het Product. 2. Deze Beperkte garantie is vierentwintig (24) maanden geldig, te beginnen bij de originele aankoopdatum van het mobiele toestel, en twaalf (12) maanden geldig voor accessoires (zowel tijdens verkoop bijgesloten in het pakket van het mobiel toestel of apart verkocht) met uitzondering van de media waarop de software staat, cd-rom,

Beperkte garantie wordt geclaimd. Deze Beperkte garantie is alleen geldig en afdwingbaar in landen waar het Product wordt verkocht. Als het Product echter is gekocht in een lidstaat van de Europese Unie, IJsland, Noorwegen, Zwitserland of Turkije en het de intentie van HTC is het Product te verkopen in een van deze landen, is deze Beperkte garantie geldig en afdwingbaar in al deze landen. Als het Product in een ander dan bovenstaande landen gekocht is, probeert HTC indien nodig het Product te repareren, al wordt geen garantie gegeven over de uitkomst hiervan. De beschikbaarheid van de garantieservice en responstijden kunnen per land verschillen en kunnen afhankelijk zijn van de registratievereiste in het land van aankoop. 3. Tijdens de Garantieperiode zal HTC of een geautoriseerde agent ervan, naar eigen goeddunken, kostenloos en in overeenstemming met paragraaf 7, een defect Product repareren of vervangen. Reparatie of vervanging kan het gebruik van een ander maar gelijkwaardige eenheid betekenen. HTC retourneert het gerepareerde Product of een ander functioneel equivalent Product in werkende staat aan de Klant. Alle vervangen beschadigde (onder)delen worden het eigendom van HTC. 4. Deze Beperkte garantie is alleen van toepassing op de originele hardwarecomponenten van het Product, en is niet van toepassing op software of andere apparatuur. 5. Als HTC het Product repareert of vervangt, valt het gerepareerde

of gedurende (3) maanden vanaf de datum van reparatie of vervanging, de langstdurende geldt. 6. Voordat u een apparaat retourneert voor reparatie, zorgt u dat u een reservekopie van gegevens maakt, en dat u vertrouwelijke en persoonlijke informatie en informatie die uw persoonlijk eigendom is van het Product verwijdert. HTC is, wanneer u geen reservekopie maakt van uw gegevens, niet verantwoordelijk voor schade of verlies van programma’s, gegevens of verwisselbare opslagmedia. 7. DEZE BEPERKTE GARANTIE IS NIET VAN TOEPASSING ALS HET DEFECT IS VEROORZAAKT DOOR ÉÉN VAN ONDERSTAANDE: a) het serienummer, datumcode van het accessoire of IMEI- nummer, watermerk of garantiezegel is verwijderd, gewist, beschadigd, veranderd of onleesbaar; of b) de beschadiging van het Product is het resultaat van normaal verbruik; of c) het defect is veroorzaakt doordat het Product op een manier is gebruikt die niet in overeenstemming is met de handleiding, het resultaat is van ruwe omgang, blootstelling aan vocht, vloeistof of extreme temperaturen of omgevingsfactoren, of een plotselinge verandering van deze factoren, corrosie, oxidatie, ongeoorloofde veranderingen of aansluitingen, ongeoorloofde opening of reparatie, reparatie door het gebruik van niet goedgekeurde reserveonderdelen, ongelukken,

controle van HTC (inclusief maar niet beperkt tot defecten van wegwerpproducten, zoals batterijen, die van nature een beperkte levensduur hebben, en breken of beschadiging van antennes), tenzij het defect direct is veroorzaakt door materiaal- of fabricagefouten. Deze Beperkte Garantie dekt niet de fysieke schade op het oppervlak van het Product, inclusief maar niet beperkt tot scheuren of krassen op het LCD-scherm of cameralens; of d) de gebreken zijn veroorzaakt doordat de batterij is kortgesloten of doordat de zegels van de batterijomhulling of cellen zijn verbroken of vertonen tekenen dat er mee is geknoeid, of doordat de batterij in niet-gespecificeerde apparatuur is gebruikt ; of e) het defect is veroorzaakt door een defect van het mobiele netwerk of ander systeem; of f) de software van het Product dient te worden geüpgrade door wijzigingen in het mobiele netwerk; of g) het defect is veroorzaakt door het feit dat het Product gebruikt is met of is aangesloten op een accessoire die niet is goedgekeurd of geleverd door HTC of is gebruikt op een onbedoelde wijze en als kan worden aangetoond door HTC dat zo’n defect niet een gebrek is van het Product zelf. 8. Bepaalde elementen van het Product kunnen per land verschillen,

originele land van bestemming naar een ander land. Het Product kan dan landspecifieke elementen bevatten die volgens deze Beperkte Garantie niet als defect worden beschouwd. ELKE AANSPRAAK OP DEZE BEPERKTE GARANTIE IS ONDERHEVIG AAN HET OP DE HOOGTE STELLEN VAN HTC OF EEN DOOR HTC GEAUTORISEERDE SERVICE AGENT VAN HET ZOGENAAMDE DEFECT BINNEN EEN REDELIJKE TIJD NADAT U HET OPGEMERKT HEEFT EN IN IEDER GEVAL NIET LATER DAN VOOR AFLOOP VAN DE GARANTIEPERIODE. 9. In het geval van storing van het Product dient de Klant de volgende handelingen te verrichten: a) Raadpleeg de gebruikershandleiding om het probleem te herkennen en eventueel te verhelpen. b) Als het probleem niet kan worden opgelost door de handleiding te raadplegen, dient de Klant contact op te nemen met de dealer waar het Product is gekocht of de lokale website van HTC te bezoeken www.htc.com voor meer informatie. c) Voordat de Klant contact op neemt met een HTC service agent, zorgt deze dat de volgende informatie bij de hand is: • Het model- en serienummer, IMEI-nummer van het Product. • Het volledige adres en contactinformatie van de Klant. • Een kopie van de originele factuur, bon of rekening van de aankoop van het Product. HTC voorziet de Klant van

het defecte Product. HTC betaalt de kosten die gemaakt zijn voor zowel verzenden van het defecte product naar HTC als terugzenden van het gerepareerde Product naar de Klant als het Defecte Product binnen de Garantieperiode valt. 10. DEZE BEPERKTE GARANTIE VERMELDT DE COMPLETE GARANTIE DIE HTC VERLEENT AAN DE KLANT. IN GEEN ENKEL GEVAL ZAL HTC ONDER DEZE BEPERKTE GARANTIE AANSPRAKELIJKE WORDEN GEHOUDEN VOOR GEDERFDE WINST, VERLIES VAN VERWACHTE BESPARINGEN, VERLIES VAN GEGEVENS, VERLIES VAN GEBRUIK VAN HET PRODUCT OF BEGELEIDENDE APPARATUUR OF INDIRECTE, INCIDENTELE SCHADE OF GEVOLGSCHADE OF WAT VOOR BESCHADIGINGEN DAN OOK. ELKE AANSPRAKELIJKHEID VOOR ZULK VERLIES OF ZULKE BESCHADIGINGEN WORDT AFGEWEZEN VOOR ZOVER WETTELIJKE VOORSCHRIFTEN DIT TOESTAAN. IN IEDER GEVAL IS DE VOLLEDIGE AANSPRAKELIJKHEID VAN HTC EN ZIJN LEVERANCIERS ONDER ELKE VOORWAARDE VAN DEZE BEPERKTE GARANTIE BEPERKT TOT HET BEDRAG DAT DE KLANT DAADWERKLIJK BETAALD HEEFT VOOR DE HARDWARE. Η HTC εγγυάται ότι το προϊόν κατά το χρόνο της αρχικής του αγοράς δεν παρουσιάζει ελαττώματα στα υλικά και την εργασία («Περιορισμένη εγγύηση»). Η ΠΑΡΟΥΣΑ ΠΕΡΙΟΡΙΣΜΕΝΗ ΕΓΓΥΗΣΗ ΔΕΝ ΕΠΗΡΕΑΖΕΙ ΤΑ ΔΙΚΑΙΩΜΑΤΑ ΣΑΣ ΣΥΜΦΩΝΑ ΜΕ ΤΟ ΝΟΜΟ. Η παρούσα Περιορισμένη εγγύηση υπόκειται στους ακόλουθους όρους και προϋποθέσεις: 1. Η Περιορισμένη εγγύηση χορηγείται μόνο στον αρχικό αγοραστή του Προϊόντος («Πελάτης»). Η παρούσα Περιορισμένη εγγύηση μπορεί, πάντως, να μεταβιβάζεται σε οποιοδήποτε άτομο προς το οποίο πωλείται το Προϊόν, όταν η HTC έχει δώσει τη γραπτή συγκατάθεσή της για τη μεταβίβαση (και η HTC δεν θα αρνηθεί να δώσει τη συγκατάθεσή της χωρίς βάσιμο λόγο). Δεν θα εξαιρεί ούτε θα περιορίζει α) οποιαδήποτε δικαιώματα του Πελάτη σύμφωνα με το νόμο, ή β) οποιαδήποτε δικαιώματα του Πελάτη κατά του πωλητή/ αντιπροσώπου του Προϊόντος. 2. Η διάρκεια ισχύος της παρούσας Περιορισμένης εγγύησης ορίζεται σε είκοσιτέσσερις (24) μήνες από την ημερομηνία της αρχικής αγοράς για κινητές συσκευές, και δώδεκα (12) μήνες για τα παρελκόμενα (είτε αυτά περιλαμβάνονται στο πακέτο πώλησης της

Πάντως, εάν έχετε αγοράσει το Προϊόν σε χώρα-μέλος της Ευρωπαϊκής Ένωσης, Ισλανδία, Νορβηγία, Ελβετία ή Τουρκία και η αρχική πρόθεση της HTC ήταν να πωλήσει το Προϊόν σε μία από τις χώρες αυτές, η παρούσα Περιορισμένη εγγύηση ισχύει και είναι εκτελεστή σε όλες τις προαναφερθείσες χώρες. Επιπλέον, εάν το Προϊόν έχει αγοραστεί σε διαφορετικό μέρος από τα προαναφερθέντα, η HTC καταβάλλει προσπάθεια επισκευής του Προϊόντος αλλά δεν μπορεί να εγγυηθεί το αποτέλεσμα. Η διαθεσιμότητα εξυπηρέτησης για τους σκοπούς της Εγγύησης και οι χρόνοι ανταπόκρισης ενδέχεται να διαφέρουν από χώρα σε χώρα και ενδέχεται επίσης να υπόκεινται σε υποχρέωση εγγραφής στη χώρα όπου πραγματοποιήθηκε η αγορά. 3. Σε όλη τη διάρκεια της Περιόδου εγγύησης η HTC ή ο εξουσιοδοτημένος πράκτοράς της θα προχωρήσουν, κατά την κρίση τους, χωρίς χρέωση και σύμφωνα με τα όσα ορίζονται στη Ρήτρα 7 στην επισκευή ή αντικατάσταση τυχόν ελαττωματικού Προϊόντος. Η επισκευή ή αντικατάσταση ενδέχεται να εμπεριέχει τη χρήση μιας λειτουργικά ισοδύναμης μονάδας που υπέστη γενική επισκευή. Η HTC υποχρεούται να επιστρέψει το επισκευασμένο Προϊόν ή εκείνο που αντικαταστάθηκε με ένα λειτουργικά ισοδύναμο Προϊόν στον

ελαττωματικά μέρη ή εξαρτήματα θα περιέλθουν στην ιδιοκτησία της HTC. 4. Η παρούσα Περιορισμένη εγγύηση αφορά μόνον τα εξαρτήματα υλικού του Προϊόντος όπως αρχικά παραδόθηκε και δεν ισχύει για την περίπτωση λογισμικού ή άλλου εξοπλισμού. 5. Εάν η HTC επισκευάσει ή αντικαταστήσει το Προϊόν, το επισκευασμένο ή αντικατεστημένο Προϊόν θα συνεχίσει να καλύπτεται από την εγγύηση για το υπόλοιπο του χρόνου της αρχικής Περιόδου εγγύησης ή για τρεις (3) μήνες από την ημερομηνία της επισκευής ή αντικατάστασης, οποιοδήποτε είναι μεγαλύτερο. 6. Πριν από την αποστολή οποιασδήποτε μονάδας για σέρβις, φροντίστε για τη δημιουργία εφεδρικών αντιγράφων των δεδομένων σας και την αφαίρεση τυχόν απορρήτων, ιδιοκτησιακών ή προσωπικών πληροφοριών από το Προϊόν. Η HTC δεν ευθύνεται για την πρόκληση βλάβης ή την απώλεια τυχόν προγραμμάτων, δεδομένων ή αφαιρούμενων μέσων αποθήκευσης σε περίπτωση που δεν φροντίσατε για τη δημιουργία εφεδρικών αντιγράφων των δεδομένων σας. 7. Η ΠΑΡΟΥΣΑ ΠΕΡΙΟΡΙΣΜΕΝΗ ΕΓΓΥΗΣΗ ΔΕΝ ΘΑ ΙΣΧΥΕΙ ΕΑΝ ΤΟ ΕΛΑΤΤΩΜΑ ΟΦΕΙΛΕΤΑΙ ΣΕ ΕΝΑ ΑΠΟ ΤΑ ΑΚΟΛΟΥΘΑ: α) αφαίρεση, διαγραφή, καταστροφή της ευκρίνειας, μεταβολή ή δυσανάγνωστο του αριθμού εργοστασιακής κατασκευής

αριθμού IMEI, της ένδειξης νερού ή της σφραγίδας εγγύησης, ή β) επιδείνωση του Προϊόντος λόγω φυσιολογικής φθοράς, ή γ) χρήση διαφορετική από εκείνη που περιγράφεται στο εγχειρίδιο χρήστη, κακομεταχείριση, έκθεση σε σταγονίδια νερού, υγρασία ή ακραίες συνθήκες θερμοκρασίας ή περιβάλλοντος ή ταχεία μεταβολή αυτών των συνθηκών, διάβρωση, οξείδωση, μη εξουσιοδοτημένες τροποποιήσεις ή συνδέσεις, μη εξουσιοδοτημένο άνοιγμα ή επισκευή, επισκευή χρησιμοποιώντας μη εγκεκριμένα ανταλλακτικά, ατυχήματα, δυνάμεις της φύσης, ή άλλες ενέργειες πέραν του εύλογου ελέγχου της HTC (που περιλαμβάνουν αλλά δεν περιορίζονται σε ανεπάρκεια αναλώσιμων μερών) εκτός και αν το ελάττωμα προκλήθηκε απευθείας από ελαττώματα σε υλικά και εργασία. στις παραμέτρους του κυψελοειδούς δικτύου, ή ζ) το ελάττωμα προκλήθηκε από το γεγονός ότι το Προϊόν χρησιμοποιήθηκε ή συνδέθηκε σε παρελκόμενο που δεν εγκρίθηκε ούτε παραχωρήθηκε από την HTC ή χρησιμοποιήθηκε με διαφορετικό τρόπο από τον ενδεδειγμένο και στην περίπτωση που μπορεί να αποδειχθεί από την HTC ότι το ελάττωμα δεν οφείλεται σε σφάλμα του ιδίου του Προϊόντος. 8. Το Προϊόν σας ενδέχεται να περιέχει στοιχεία ειδικά της χώρας, περιλαμβανομένου και λογισμικού. Εάν το Προϊόν έχει επανεξαχθεί από την αρχική χώρα προορισμού σε άλλη χώρα, το Προϊόν ενδέχεται να περιέχει στοιχεία ειδικά της χώρας αυτής, που δεν θεωρείται ότι αποτελούν ελάττωμα σύμφωνα με τους όρους της παρούσας Περιορισμένης εγγύησης. ΟΠΟΙΑΔΗΠΟΤΕ ΑΞΙΩΣΗ ΣΥΜΦΩΝΑ ΜΕ ΤΟΥΣ ΟΡΟΥΣ ΤΗΣ ΠΑΡΟΥΣΑΣ ΠΕΡΙΟΡΙΣΜΕΝΗΣ ΕΓΓΥΗΣΗΣ ΥΠΟΚΕΙΤΑΙ ΣΤΟ ΚΑΤΑ ΠΟΣΟΝ ΕΝΗΜΕΡΩΣΑΤΕ ΤΗΝ HTC Ή ΚΑΠΟΙΟΝ ΕΞΟΥΣΙΟΔΟΤΗΜΕΝΟ ΠΡΑΚΤΟΡΑ ΣΕΡΒΙΣ ΣΧΕΤΙΚΑ ΜΕ ΤΟ ΥΠΟΤΙΘΕΜΕΝΟ ΕΛΑΤΤΩΜΑ ΕΝΤΟΣ ΕΥΛΟΓΟΥ ΧΡΟΝΙΚΟΥ ΠΕΡΙΘΩΡΙΟΥ ΑΠΟ ΤΗ ΣΤΙΓΜΗ ΠΟΥ ΑΥΤΟ ΕΠΕΣΕ ΣΤΗΝ ΑΝΤΙΛΗΨΗ ΣΑΣ ΚΑΙ ΣΕ ΚΑΘΕ ΠΕΡΙΠΤΩΣΗ ΟΧΙ ΑΡΓΟΤΕΡΑ ΑΠΟ ΤΗ ΛΗΞΗ ΤΗΣ ΠΕΡΙΟΔΟΥ ΕΓΓΥΗΣΗΣ. 9. Σε περίπτωση αστοχίας του Προϊόντος, ο Πελάτης θα πρέπει να ενεργήσει ως ακολούθως: α) Να ανατρέξει στο εγχειρίδιο χρήστη ώστε να ταυτοποιήσει και

β) Εάν δεν είναι δυνατή η επίλυση του προβλήματος ανατρέχοντας στο εγχειρίδιο χρήστη, ο Πελάτης θα πρέπει στη συνέχεια να απευθυνθεί στον αντιπρόσωπο από τον οποίο αγόρασε το Προϊόν ή να επισκεφθεί την τοπική ιστοσελίδα της HTC, ή το κέντρο σέρβις της HTC ή τη διεύθυνση www.htc.com για περαιτέρω πληροφορίες. γ) Ο Πελάτης, πριν από την επικοινωνία του με τον πράκτορα σέρβις της HTC, θα πρέπει να φροντίσει ώστε να έχει πρόχειρες τις ακόλουθες πληροφορίες: • Το μοντέλο και τον αριθμό εργοστασιακής κατασκευής, τον αριθμό IMEI του Προϊόντος. • Την πλήρη διεύθυνση και τις πληροφορίες επικοινωνίας του Πελάτη. • Ένα αντίγραφο του αρχικού τιμολογίου Πελάτη, απόδειξης ή πωλητηρίου της αγοράς του Προϊόντος. Η HTC θα παράσχει στον Πελάτη οδηγίες σχετικά με το πως και πότε θα πρέπει να επιστραφεί το ελαττωματικό Προϊόν. Η HTC θα καταβάλει το κόστος επιστροφής του ελαττωματικού Προϊόντος στην HTC και αποστολής του επισκευασμένου Προϊόντος στον Πελάτη, εάν το ελαττωματικό Προϊόν καλύπτεται από την Περίοδο ισχύος της εγγύησης. 10. Η ΠΑΡΟΥΣΑ ΠΕΡΙΟΡΙΣΜΕΝΗ ΕΓΓΥΗΣΗ ΠΕΡΙΛΑΜΒΑΝΕΙ ΤΟ ΣΥΝΟΛΟ ΤΗΣ ΕΓΓΥΗΣΗΣ ΠΟΥ ΠΑΡΕΧΕΤΑΙ ΑΠΟ ΤΗΝ HTC ΠΡΟΣ ΤΟΝ ΠΕΛΑΤΗ.

Türkiye’de satın aldıysanız ve HTC bu ülkelerden birinde Ürünün satışını yapmayı planladıysa, bu Sınırlı Garanti yukarıda belirtilen ülkelerin hepsinde geçerlidir. Bundan başka, Ürün yukarıda belirtilen ülkelerden başka bir yerde satın alındıysa, HTC söz konusu Ürünü onarmaya çalışır ancak sonucu garanti edemez. HTC Müşteriye arızalı Ürünün nasıl ve ne zaman iade edilmesi gerektiğiyle ilgili talimatları

5. INDEMNIFICATION. You agree to hold harmless, indemnify and defend HTC, its officers, directors and employees, from and against any losses, damages, fines and expenses (including attorneys’ fees and costs) arising out of or relating to any claims that you have (i) viewed, downloaded, encoded, compressed, copied or transmitted any materials (other than materials provided by HTC) in connection with the Software in violation of another party’s rights or in violation of any law, or (ii) violated any terms of this License Agreement. If you are importing the Software from the United States or European Union, you shall indemnify and hold HTC harmless from and against any import and export duties or other claims arising from such importation. You agree that the laws of the State of Washington, the United States (excluding its conflict of laws) shall govern any and all matters resulted from this Agreement. 6. TERMINATION. This License Agreement will automatically terminate if you fail to comply with any term hereof. No notice shall be required from HTC to effect such termination.

WINDOWS MOBILE 6 SOFTWARE These license terms are an agreement between you and HTC Corporation (“Company”). Please read them. They apply to the software included on this device. The software also includes any separate media on which you received the software. The software on this device includes software licensed by Company from Microsoft Corporation or its affiliate. The terms also apply to any • updates, • supplements, • Internet-based services, and • support services for this software, unless other terms accompany those items. If so, those terms apply. As described below, using some features also operates as your consent to the transmission of certain standard computer information for Internet-based services. By using the software, including use on this device, you accept these terms. If you do not accept them, do not use the device or software. Instead, contact Company to determine its return policy for a refund or credit.

If you comply with these license terms, you have the rights below. 1. USE RIGHTS. You may use the software on the device with which you acquired the software. 2. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS. a. Specific Use. Company designed this device for a specific use. You may only use the software for that use. b. Included Microsoft Programs and Additional Required Licenses. Except as provided below, these license terms apply to all Microsoft programs included with the software. If the license terms with any of those programs give you other rights that do not expressly conflict with these license terms, you also have

If the software includes speech recognition component(s), you understand that speech recognition is an inherently statistical process and that recognition errors are inherent in the process. Neither Company nor Microsoft or their suppliers shall be liable for any damages arising out of errors in the speech recognition process. d. Phone Functionality. If the device software includes phone functionality, all or certain portions of the device software may be inoperable if you do not have and maintain a service account with a wireless telecommunication carrier (“Mobile Operator”), or if the Mobile Operator’s network is not operating or configured to operate with the device. 3. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to use the software. Company and Microsoft reserve all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that allow you to use it only in certain ways. You may not: • work around any technical limitations in the software;

• make more copies of the software than specified in this agreement; • publish the software for others to copy; • rent, lease or lend the software; or • use the software for commercial software hosting services. Except as expressly provided in this agreement, rights to access the software on this device do not give you any right to implement Microsoft patents or other Microsoft intellectual property in software or devices that access this device. You may use remote access technologies in the software such as Remote Desktop Mobile to access the software remotely from a computer or server. You are responsible for obtaining any licenses required for use of the protocols to access other software. 4. INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the software. Microsoft may change or cancel them at any time. a. Consent for Internet-Based Services. The software features described below connect to Microsoft or service provider computer systems over the Internet. In some cases, you will not receive a separate notice when they connect. The following features use Internet protocols, which send to the appropriate systems device information, such as your Internet protocol address, the type of operating system, browser and name and version of the software you are using, and the language code of the device where you installed the software. Microsoft uses this information to make the Internet-based services available to you. • Windows Mobile Update Feature. The Windows Mobile Update feature provides you the ability to obtain and install software updates on your device if updates are available. You may choose not to use this feature. Company and/or your Mobile Operator may not support this feature or an update for your device. • Windows Media Digital Rights Management. Content owners use Windows Media digital rights management technology (WMDRM) to protect their intellectual property, including copyrights. This software and third party software use WMDRM to play and copy WMDRM-protected content. If the software fails to protect the content, content owners may ask Microsoft to revoke the software’s ability to use WMDRM to play or copy protected content. Revocation does not affect other content. When you download licenses for protected content, you agree that Microsoft may include a revocation list with the licenses. Content owners may require you to upgrade WMDRM to access their content. Microsoft software that

you decline an upgrade, you will not be able to access content that requires the upgrade. b. Misuse of Internet-based Services. You may not use these services in any way that could harm them or impair anyone else’s use of them. You may not use the services to try to gain unauthorized access to any service, data, account or network by any means. 5. NOTICES ABOUT THE MPEG-4 VISUAL STANDARD. The software may include MPEG-4 visual decoding technology. This technology is a format for data compression of video information. MPEG LA, L.L.C. requires this notice: USE OF THIS PRODUCT IN ANY MANNER THAT COMPLIES WITH THE MPEG 4 VISUAL STANDARD IS PROHIBITED, EXCEPT FOR USE DIRECTLY RELATED TO (A) DATA OR INFORMATION (i) GENERATED BY AND OBTAINED WITHOUT CHARGE FROM A CONSUMER NOT THEREBY ENGAGED IN A BUSINESS ENTERPRISE, AND (ii) FOR PERSONAL USE ONLY; AND (B) OTHER USES SPECIFICALLY AND SEPARATELY LICENSED BY MPEG LA, L.L.C. Refer to the support number provided with the device. 10. LINKS TO THIRD PARTY WEBSITES. If the software provides links to third party websites, those links are provided to you only as a convenience, and the inclusion of any link does not imply an endorsement of the third party website by Microsoft. 11. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the software on the device. 12. PROOF OF LICENSE. If you acquired the software on the device, or on a disc or other media, a genuine Certificate of Authenticity label with a genuine copy of the software identifies licensed software. To be valid, this label must be affixed to the device, or included on or in Company’s software packaging. If you receive the label separately, it is not valid. You should keep the label on the device or packaging to prove that you are licensed to use the software. To identify genuine

13. TRANSFER TO A THIRD PARTY. You may transfer the software only with the device, the Certificate of Authenticity label, and these license terms directly to a third party. Before the transfer, that party must agree that these license terms apply to the transfer and use of the software. You may not retain any copies of the software including the backup copy. 14. NOT FAULT TOLERANT. The software is not fault tolerant. Company installed the software on the device and is responsible for how it operates on the device. 15. RESTRICTED USE. The Microsoft software was designed for systems that do not require fail-safe performance. You may not use the Microsoft software in any device or system in which a malfunction of the software would result in foreseeable risk of injury or death to any person. This includes operation of nuclear facilities, aircraft navigation or communication systems and air traffic control. 16. NO WARRANTIES FOR THE SOFTWARE. The software is provided “as is”. You bear all risks of using it. Microsoft gives no express warranties, guarantees or conditions. Any warranties you receive regarding the device or the software do not originate from, and are not binding on, Microsoft or its affiliates. When allowed by your local laws, Company and Microsoft exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

affiliates only direct damages up to fifty U.S. Dollars (U.S. $50.00). You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages. This limitation applies to: • anything related to the software, services, content (including code) on third party internet sites, or third party programs, and • claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law. It also applies even if Microsoft should have been aware of the possibility of the damages. The above limitation may not apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages. 18. EXPORT RESTRICTIONS. The software is subject to United States export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the software.
